Constitutional Court nullifies key provision of Public Order Management Act, 2013 (POMA)


On March 26, 2020 Constitutional Court of the republic of Uganda annulled the section 8 of the Public Order Management Act, 2013 (POMA) and declared all acts done under the law null and void.

The petitioners in Constitutional Petition number 56 of 2013, Human Rights Network Uganda & 4 others Vs Attorney General of Uganda petitioned the court in 2013.

In a 4 – 1 decision, the court ruled that the law was inconsistent with the 1995 Constitution of the Republic of Uganda. Striking down section 8 of the said law has the effect of rendering the entire law redundant and halting all prosecutions of all persons who were being tried under the law.
